Terms of Use
These Terms of Service ("Terms" or "ToS") govern your access to and use of the DashHaul LLC website, mobile application(s), and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. About These Terms
These Terms are intended to: Require users to remain informed of the most current version of the Terms; Protect DashHaul LLC's intellectual property and platform integrity; Ensure users only upload lawful content they have the right to use; Define the use of third-party payment services where applicable; Limit DashHaul LLC's liability to the maximum extent permitted under U.S. law; and Protect DashHaul LLC against fraud, abuse, manipulation, and misuse of the Service.
2. Changes to the Terms
DashHaul LLC may update these Terms from time to time. Updated Terms will be made available within the Service. Changes are effective immediately for new users and 30 days after posting for existing users. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
3. Eligibility and Registration
You must be at least 18 years old and legally able to enter into a binding contract under applicable U.S. law. Only natural persons may register unless explicitly approved by DashHaul LLC. Each user may maintain only one account. DashHaul LLC reserves the right to refuse, suspend, or terminate access at its sole discretion for violations of these Terms, suspected fraud, manipulation, or unlawful activity.
4. Description of the Service
DashHaul LLC provides a digital marketplace enabling users to post listings ("Advertisers") and respond to listings ("Helpers"). DashHaul LLC is not a party to any agreement between users and does not guarantee performance, quality, legality, or safety of user transactions.
5. User Conduct and Fraud Prevention
You agree not to:
- Engage in fraud, sham transactions, collusion, or manipulation;
- Misrepresent your identity, eligibility, or intent;
- Circumvent platform fees or payment systems;
- Arrange off-platform payments or services;
- Use the Service for illegal, deceptive, or abusive purposes;
- Interfere with the security or operation of the Service.
DashHaul LLC may monitor activity, investigate suspicious behavior, suspend accounts, reverse benefits, deny discounts, or take legal action to protect the platform and its users.
6. Intellectual Property
All content, design, software, trademarks, and materials within the Service are owned by or licensed to DashHaul LLC and are protected under U.S. and international intellectual property laws.
You may not copy, reproduce, distribute, frame, scrape, or exploit any part of the Service without prior written consent.
Unauthorized use may result in civil and criminal liability.
7. User-Generated Content
You retain ownership of content you submit ("User Content"). By submitting User Content, you represent that:
- You own or have rights to the content;
- The content is lawful and non-infringing;
- Any identifiable persons have provided consent.
You grant DashHaul LLC a non-exclusive, worldwide, royalty-free, perpetual license to use, host, reproduce, modify, distribute, and display User Content for Service operation, moderation, and marketing.
You waive any claims for compensation related to such use.
8. Messaging and Communications
Users must communicate respectfully. The following are prohibited:
- Harassment, threats, or abusive language
- Spam or unsolicited messages
- Misleading, illegal, or harmful communications
- Requests for off-platform payments or altered pricing
DashHaul LLC may remove content, restrict messaging, or suspend accounts to enforce these rules.
9. Payments and Fees
Where payment features are available, payments between users are processed by third-party providers such as Stripe, Inc. Use of payment features is subject to Stripe's terms. DashHaul LLC may charge transaction or administrative fees, disclosed at the time of use. Attempts to avoid fees constitute a violation of these Terms. DashHaul LLC is not responsible for payment failures caused by third-party processors.
10. Taxes
You are solely responsible for reporting and paying any applicable taxes arising from your use of the Service. DashHaul LLC does not provide tax advice.
11. Insurance
DashHaul LLC does not provide insurance unless explicitly stated. Users are responsible for maintaining appropriate coverage for their activities.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY U.S. LAW, DASHHAUL LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
DashHaul LLC does not guarantee uninterrupted or error-free operation.
13. Platform Disclaimer
DashHaul LLC operates as a digital marketplace that connects individuals who need help with independent helpers willing to perform tasks. DashHaul LLC does not provide the services listed on the platform and does not employ, supervise, or control helpers. All services are performed by independent individuals who are solely responsible for the work they provide.
By using the platform, you acknowledge that any agreement for services is made directly between the advertiser and the helper. DashHaul LLC is not a party to those agreements and does not guarantee the quality, safety, legality, or completion of any services arranged through the platform.
14. Limitation of Liability
To the maximum extent permitted by law, DashHaul LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to the use of the platform or services arranged through the platform.
DashHaul LLC shall not be responsible for any property damage, loss, theft, personal injury, or other harm that may occur during the performance of tasks between users. All interactions and transactions between advertisers and helpers occur at the users' own risk.
15. No Insurance Coverage
DashHaul LLC does not provide insurance coverage for services performed through the platform. Users are responsible for ensuring they have appropriate insurance or protection if they consider it necessary.
16. User Responsibility
Users are responsible for their own actions and conduct while using the platform. DashHaul LLC does not guarantee the identity, reliability, or qualifications of any user. Users should exercise their own judgment before engaging in any transaction or service arrangement.
17. Indemnification
You agree to indemnify and hold harmless DashHaul LLC, its owners, employees, and affiliates from any claims, damages, losses, liabilities, or expenses, including legal fees, arising from your use of the platform, your interaction with other users, your user content, or your violation of these Terms or applicable law.
18. Termination
DashHaul LLC may suspend or terminate access to the platform at any time, with or without notice, if a user violates these Terms, engages in fraudulent activity, or if termination is necessary to protect the platform or comply with legal obligations.
19. Privacy
DashHaul LLC processes user information in accordance with its Privacy Policy. By using the platform, you agree to the collection and use of information as described in that policy.
20. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms or the use of the platform shall be resolved in the state or federal courts located in the United States, unless mandatory law requires otherwise.

22. Assumption of Risk
By using the DashHaul platform, you acknowledge that engaging with other users, including helpers and advertisers, involves inherent risks. These risks may include property damage, theft, personal injury, disputes between users, or failure to complete a task as expected. You agree that you voluntarily assume all risks associated with arranging or performing services through the platform. DashHaul LLC is not responsible for the conduct, actions, or omissions of any user.
23. No Warranty
The DashHaul platform and all services provided through it are offered on an "as is" and "as available" basis. DashHaul LLC makes no warranties or representations regarding the reliability, availability, safety, or quality of the platform or any services arranged through it. DashHaul LLC does not guarantee that the platform will operate without interruption, errors, or security vulnerabilities. To the maximum extent permitted by law, all implied warranties including merchantability, fitness for a particular purpose, and non-infringement are disclaimed.
24. Dispute Between Users
DashHaul LLC is not responsible for resolving disputes between advertisers and helpers. Any disagreements regarding services, payments, damages, or other issues must be resolved directly between the users involved. DashHaul LLC may choose to assist in resolving disputes at its sole discretion, but it has no obligation to intervene or provide compensation in any dispute between users.
25. Responsibility for Damages
Helpers are solely responsible for any damage, loss, or theft that occurs during the performance of services. Advertisers acknowledge that DashHaul LLC does not supervise or control helpers and therefore cannot be held responsible for damages resulting from services arranged through the platform. Any claims related to property damage, loss of items, or theft must be addressed directly between the advertiser and the helper involved.
26. Arbitration and Class Action Waiver
Any dispute, claim, or controversy arising out of or relating to these Terms, the use of the DashHaul platform, or services arranged through the platform shall be resolved through binding arbitration rather than in court, except where prohibited by applicable law. Arbitration shall be conducted by a neutral arbitrator in accordance with the applicable arbitration rules. The arbitration will take place in the United States unless otherwise required by mandatory law.
By agreeing to these Terms, you understand and agree that you are giving up the right to bring claims in court before a judge or jury, except where such waiver is not permitted by law. You further agree that any dispute resolution will be conducted only on an individual basis and not as part of a class action, collective action, or representative proceeding. Users waive any right to participate in a class action lawsuit or class-wide arbitration against DashHaul LLC.
